Terms of Service

1. Who you are contracting with

Services are provided by Artem Keybal, an independent web developer operating as keybal.dev, based in Calgary, Alberta, Canada. Contact: (+1) 647 87 89 643 or the contact form on this website. In these terms, "I" and "me" mean the provider, and "you" means the client.

2. Prices, currency and tax

All prices are in Canadian dollars. Where sales tax applies, it is shown at checkout or added to the invoice. Third-party costs — domain registration, paid plugins, stock licences, ad spend — are separate from my fees and are stated before you commit to them.

3. Payment

Fixed-price products are paid in full before work starts. Larger projects are paid in stages as set out in Section C. Subscriptions are charged automatically until cancelled. Invoices are due on receipt unless the invoice says otherwise. If an invoice is more than 14 days overdue, I may pause work and suspend related services until it is settled.

4. What I need from you

You are responsible for the accuracy of the information you give me, and for having the right to use everything you send — logos, photographs, text, trademarks and material from other sources. I build from the facts and sources you provide and do not invent claims, credentials, results or reviews. If you supply inaccurate information, the work will reflect it, and correcting it afterwards counts against your revisions or is billed as extra time.

5. Communication and delays

I work in writing — email, messaging or a shared document — and normally reply within one business day on weekdays. Timelines depend on you replying too. If a project sits without a response from you for 30 days, I may treat it as paused and invoice the work completed to that point; restarting later may be re-quoted at current prices.

6. How the work is produced

I use AI tools as part of my process — typically to draft layout and a first pass of copy from the sources you provide, and sometimes to generate images. I make the design and technical decisions, check every stated fact against your materials, test the result, and remain responsible for what is delivered.

7. Confidentiality and your data

I keep your business information, credentials and files confidential and use them only to deliver your work. I do not sell or share them. How personal data is handled is set out in the Privacy Policy. Please send passwords through a password manager or a secure share rather than plain email or chat.

8. What I do not guarantee

I cannot guarantee search rankings, traffic, enquiries, sales, conversion rates or any specific business outcome — those depend on your market, your offer, your pricing and factors outside my control. Third-party services such as registrars, hosting providers, payment processors, Google and Meta are outside my control, and their outages, price changes or policy decisions are not my responsibility. My total liability for any claim is limited to the amount you paid me for the service the claim relates to. I am not liable for indirect or consequential loss, including lost profit or lost data where you declined backups.

9. Acceptable use

I do not work on illegal activity, adult content, gambling, or anything designed to deceive people. If a project turns out to fall into these categories after payment, I will cancel it and refund you in full.

10. What you are buying

• Express ($99 CAD) — one one-page website in the style you choose, published within 24 hours of a complete brief. Includes one revision round.
• Reviewed ($129 CAD) — the same website, with the structure, style and service list confirmed in writing before payment. Includes two revision rounds.

These are static one-page sites with no admin panel. Edits come through me, or you can edit the files yourself at your own risk.

11. The 24-hour delivery window

The 24 hours begin when your payment has cleared and your brief is complete — including your business details, service list, and either your photos or your choice to use stock imagery. The clock does not start at payment. If materials arrive late or in parts, delivery moves accordingly. If I cannot start within a reasonable time because materials are missing, I may cancel and refund in full.

12. Revisions

A revision round means one consolidated set of changes to text, images, colours, section order and contact details. It does not mean a new design in a different style, additional pages, or new functionality. Further changes are charged at $60 CAD per hour, agreed with you before I start.

13. Refunds and cancellation

• Before I start work, you can cancel for any reason and receive a full refund.
• After delivery, if the result is not what you wanted, you get a revision round. If you still do not want it, you get a full refund and the site is not published or is taken down.
• Refunds are issued to the original payment method, normally within 5 business days.
• Domain registration fees are non-refundable once the domain is registered in your name, because that cost is paid to the registrar and the domain becomes yours.

14. Ownership

Once payment has cleared, you own the delivered website files, the content and the domain, and you receive the credentials. You can move the site to any host at any time. There is no lock-in and no ongoing licence fee. Stock images and fonts remain subject to the licences of their providers.

15. Quotes and scope

Multi-page websites, online stores, web applications and integrations are quoted individually. A quote is valid for 30 days and is based on the scope described in it. Anything not listed in the quote is out of scope. Scope changes are quoted separately and agreed in writing before I build them — I will not add work and invoice you for it afterwards.

16. Payment stages

Unless the quote says otherwise, projects are paid 50% before work starts and 50% on completion, before the site goes live on your domain. Longer projects may be split into milestones set out in the quote. Deposits cover work already scheduled and reserved and are non-refundable once work has started, though you will receive everything produced up to that point.

17. Review and acceptance

You get a review period after delivery — 7 days unless the quote says otherwise — to send one consolidated list of corrections. Corrections mean fixing things that do not match the agreed scope. If I do not hear from you within 14 days of delivery, the work is treated as accepted and any remaining balance becomes due.

18. Handover and ownership

On final payment you receive the code, content, assets and credentials, and you own them outright. Before final payment, work may be shown on a staging URL but is not licensed for live commercial use. Third-party components keep their own licences, and any paid plugin or service subscriptions are yours to maintain after handover.

19. Support after launch

Projects include a defect-fix period stated in the quote — typically 30 days — covering things that do not work as agreed. It does not cover new features, content changes, or problems caused by edits made by you or by a third party. After that period, support is available hourly or through a care plan.

20. Fees and ad spend are separate

The management fee is what you pay me. Your advertising budget is separate and is paid by you directly to Google, Meta or the relevant platform, so all of it goes to buying ads. I do not mark up ad spend. You approve the budget before anything goes live, and no budget change is made without your approval.

21. Accounts, access and ownership

Your ad accounts, pixels, conversion data and campaign history belong to you and stay in your accounts. If we stop working together, nothing is taken away or held back. If I create an account on your behalf, ownership is transferred to you.

22. Results, platforms and cancellation

Advertising results depend on your market, offer, pricing and competition, and cannot be guaranteed — see clause 8. Platforms can reject ads, suspend accounts or change their rules at any time, and their decisions are outside my control; I will work to resolve such issues but cannot promise an outcome. Management is monthly. Either of us can stop with 30 days written notice, and the current month is not pro-rated. I will hand over campaign access and the latest reporting on request.

23. Subscriptions and renewal

Hosting renews yearly and the care plan renews monthly until you cancel. You can cancel at any time and the service continues to the end of the period you have already paid for; partial periods are not refunded. If a renewal payment fails and is not resolved, the service may be suspended, and I will tell you before that happens.

24. Backups, uptime and limits

Hosted sites are backed up on the schedule of the plan you are on. I aim for continuous availability but do not guarantee uninterrupted service, since it depends on upstream providers. Plans are sized for normal small-business traffic; if a site consistently exceeds that, I will tell you and quote an upgrade rather than cut you off. If you move the site elsewhere, I will provide a copy of the files and a reasonable window to migrate.

25. Portfolio

I may show completed work, including screenshots and your business name, as an example of what I do — unless you ask me in writing not to. I never show anything you have marked confidential.

26. Which terms apply

If a written quote, proposal or order confirmation for a specific project conflicts with these terms, the project document applies for that project, and these terms cover everything it does not address. The version of these terms in force is the one published here on the date you paid; updates do not apply retroactively to work already ordered.

27. Termination and events outside our control

Either of us can end an ongoing arrangement with 30 days written notice; you pay for work completed up to that point, and I hand over what has been paid for. Neither of us is liable for delays caused by events outside reasonable control, such as illness, infrastructure failures, or provider outages — but I will tell you promptly and agree a revised timeline with you.

28. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, and the courts of Alberta have jurisdiction.
